STB Stays Effective Date of Abandonment
 
The Coalition board has been busy (see items below) and so have you! The deadline at the Surface Transportation Board for public comment on the Harsimus Branch is May 7, but your environmental comments have already made a difference.  Acknowledging more time was needed to handle comments, the STB decided April 16 to stay the effective date of abandonment indefinitely. 
 
Your contributions have given the Coalition some breathing room to focus on local actions, like the Historic Preservation Commission hardship hearing (see below).  While we turn our attention to other work, will you keep the comments coming?
 
We ask you, if you have not yet submitted a comment, to do so; see the Action Alert below for instructions. Wouldn't it be inspiring if all 1400 recipients of this newsletter weighed in? Reach out to friends and neighbors who might not have heard of this public comment opportunity.

The Harsimus Branch is as important to Jersey City's future as it was to its past.  The STB should authorize a full environmental impact statement for the Branch, so decision-makers have the best information available to them.  
 
Write whatever you like about the environmental effects of abandonment and demolition.  Please do not delay!  STB needs to know you care how its decision-making affects you.   See the Coalition web site for more information.
 Demolition Hearing 2/09
HPC To Resume Hardship Hearing

The Jersey City Historic Preservation Commission will resume hearing applications, from six LLCs and Conrail, for hardship exemptions that would allow them to demolish the Harsimus Branch Embankment.  The Commission previously denied applications for Certificates of Appropriateness for demolition of the Municipal Landmark. 
 
We cannot gauge how long these presentations will take or if public comment will be taken on this date or at a subsequent hearing. If you intend to testify against hardship exemptions,  come prepared.   Guidelines are on the Coalition's web site.
D.C. Circuit Hears Appeal Arguments
 
April 20.  Coalition representatives traveled to Washington, D.C., Monday, April 20, to hear Conrail and SLH oral arguments in their appeal of the Surface Transportation Board 2007 decisions ruling that the Harsimus Branch remained part of the national rail system.  STB defended its rulings before the U.S. Court of Appeals, D.C. Circuit. The City of Jersey City, Rails to Trails Conservancy, and the Embankment Preservation Coalition filed a brief but did not participate in the oral argument.
 
We do not know when a decision will be announced, but will let you know as soon as we do.
